Care365 Terms of Service

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR USE OF THIS WEBSITE AND YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. BY ACCESSING OR USING THIS WEBSITE OR ANY CARE365 SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND UNCONDITIONALLY AGREED TO BE BOUND BY THESE TERMS AND CONDITIONS.

No Show Policy

If you book an appointment and fail to attend without providing at least 24 hours' notice, Care365 reserves the right to charge a no-show fee equal to the full cost of the appointment.

Cancellation Policy

If you book an appointment and cancel with less than 24 hours’ notice, Care365 reserves the right to charge a cancellation fee equal to the full cost of the appointment. If you cancel an appointment with more than 24 hours' notice, Care365 will withhold a $5.00 administrative fee from your refund.

1. Introduction

These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “your,” “patient”) and Care365 Inc. (“Care365,” “we,” “our”) regarding your use of our website, platform, and services (collectively, “Services”).

By accessing or using the Care365 website or Services, you agree to comply with these Terms. If you do not agree, please discontinue using our website and Services immediately.

2. About Care365

Care365 connects individuals with Health Care Professionals (HCPs) through a secure online platform for non-emergency medical consultations via video conferencing, messaging, and scheduling. Care365 does not provide medical services; all HCPs using the platform are independent practitioners responsible for the care they provide.

3. Privacy Policy

We collect, use, disclose, retain, and process personal information in accordance with our Privacy Policy, which is available on our website. By using our Services, you acknowledge and consent to the terms of our Privacy Policy.

4. Modifications

We reserve the right to modify these Terms at any time. Changes will take effect once posted on our website. Continued use of the Services following changes constitutes acceptance of the revised Terms.

5. Eligibility and Professional Discretion

Not all individuals may be eligible to use Care365. HCPs have full discretion to determine whether telemedicine is appropriate for a patient’s condition. If an HCP determines that an in-person consultation is necessary, they may decline service and refer the patient to a clinic or hospital. Certain medications, including opioids and benzodiazepines, may not be prescribed via the platform.

6. User Account

To access the Services, you must register for an active user account (“User Account”). You must be at least 18 years old and provide accurate and complete personal information.

7. User Responsibilities

You are responsible for your account and the accuracy of the information you provide. You agree not to submit false or misleading information and to refrain from posting or transmitting: (a) Any content that infringes intellectual property rights or violates any law; (b) Any viruses, malware, or harmful code.

Care365 reserves the right to suspend or terminate accounts that violate these Terms.

8. Account Security

While we implement reasonable security measures, electronic communication carries inherent risks. Care365 is not responsible for unauthorized access to information submitted through the platform. You are responsible for safeguarding your password and must notify us immediately of any unauthorized use.

9. Data Ownership

You retain ownership of your personal information. Care365 acts as a facilitator, connecting users with independent HCPs and does not control or store medical records created during consultations.

10. Suspension or Termination of Accounts

Care365 may suspend, restrict, or terminate access to the platform at its sole discretion if there is a violation of these Terms.

11. Electronic Communications

By using Care365, you consent to receiving electronic communications, including emails and text messages. Standard messaging and data rates may apply.

12. Accuracy of Information

While we strive to ensure that our content is accurate and up to date, we do not guarantee its completeness or accuracy. Care365 does not provide medical advice; all medical guidance is the sole responsibility of independent HCPs.

13. Third-Party Links

Our website may contain links to third-party sites. Care365 does not endorse or assume responsibility for the content, products, or services of external websites.

14. Permitted Use

You are granted a limited, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial purposes.

15. Prohibited Use

You agree not to: (a) Use the platform for unauthorized advertising; (b) Upload or distribute malware; (c) Impersonate others; (d) Engage in fraudulent activities; (e) Violate any applicable laws or regulations.

16. Intellectual Property Rights

Care365 owns all intellectual property associated with its website, platform, and Services. You may not reproduce, modify, or distribute any content without explicit permission.

17. Limitation of Liability

To the maximum extent permitted by law, Care365 is not liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services.

18. Dispute Resolution

Disputes will be resolved through arbitration in Toronto, Ontario. You waive the right to participate in class action lawsuits.

19. Governing Law

These Terms are governed by the laws of Ontario, Canada.

20. Termination of Services

Care365 reserves the right to terminate access to Services at any time for any reason.
